Welcome to Fitty! These Terms of Service ("Terms") govern your use of the Fitty application and any related services provided by Isle Geeks. By using our application, you agree to these Terms.

1. Description of Service

Fitty is a digital marketing platform that provides tools for content management, scheduling, social media engagement, ad campaign management, email marketing, SEO auditing, team collaboration, and advanced content generation.

2. User Accounts

To use Fitty, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We have three user roles:

• Owner: The primary account holder, responsible for billing, subscription management, and assigning roles to team members.
• Manager: Can manage most aspects of the workspace but cannot manage billing or subscriptions.
• Basic: Has access to core features as determined by the Owner or Manager.

3. Subscriptions and Payments

Fitty offers several subscription plans (e.g., Free, Standard, Premium) and optional add-ons (e.g., Email Marketing, SEO Tools). By subscribing to a paid plan or add-on, you agree to pay the applicable fees.

• Billing: Fees are billed on a monthly or yearly basis as selected by the Owner.
• Renewals: Subscriptions automatically renew unless canceled.
• Downgrades: If a monthly core plan expires, it will automatically downgrade to the Free plan. Features associated with the higher plan will be restricted.
• Add-ons: Monthly add-on plans are deactivated upon expiry if not renewed.

4. User Content

You retain ownership of all content you create, upload, or post through Fitty ("User Content"), including text, images, videos, and campaign data. However, by using our services, you grant Fitty a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving our services.

5. Acceptable Use

You agree not to misuse the Fitty services. This includes, but is not limited to:

• Violating any laws or regulations.
• Infringing on the intellectual property rights of others.
• Uploading or sharing malicious software.
• Interfering with the normal operation of the service.
• Using the service to send spam or unsolicited messages.

6. Termination

We may terminate or suspend your account and access to the services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. You can terminate your account at any time by contacting customer support.

7. Disclaimers and Limitation of Liability

The Fitty service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free. In no event shall Fitty or Isle Geeks be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the service after any changes constitutes your acceptance of the new Terms.
